PRIVACY POLICY

Version. This version of the document is dated February 13, 2025, and comes into force since February 13, 2025.

Purpose of the Policy: This Privacy Policy describes how 100 Franklins (hereinafter also “us,” “we”) collects, uses, discloses, and otherwise processes the personal data you provide by using the 100 Franklins, Inc. website, located at https://100f.com/ (the “Website”) or the services, rendered through the Website, or any other services of 100 Franklins, Inc. (the “Service”).

Effectiveness. This Privacy Policy is effective immediately for users that leave their personal data on the Website on or after January 2025, and will become effective on January 2025.

Age Restriction. We require users of the Service to be at least 18 years of age. We do not intend for anyone under the age of 18 to use any of the features or services we offer from the Service and we do not knowingly collect personal data from anyone under the age of 18 – so, please, if you are under 18, do not use the Service. We understand and are committed to respecting the sensitive nature of people’s privacy online. If we find out or suspect you are less than 18 years old – we retain the right to limit, pause, or cancel your use of the Service in the manner we may deem feet. If you suspect that a user is under the age of 18, please, use the report profile mechanism available through the Service.

Automatic consent. When you use the Service, you become a user of the Services and consent to our collection, use, and disclosure of information about you as described in this Privacy Policy.

Terms of Use. This Policy is an inalienable part of the Terms of Use of 100 Franklins, located at 100 Franklins Terms of use, and your consent to the provisions of such Terms includes your consent to the provisions of this Policy, provided however that from time to time we may ask for your separate consent hereto. All the definitions in the Terms mean the same through the text of this Policy, unless the context strictly demands otherwise.

Personal data. As used in this Policy, “personal data” is as defined in the General Data Protection Regulation 2018 and any successor legislation, which includes any information which, either alone or in combination with other information we hold about you, identifies you as an individual, including, for example, your name, email address. We need certain personal data in order to provide you with access to our Service.

Purpose of processing. The only reason we process your personal data is to negotiate, conclude, and perform the contract that you have with us by having you provide your personal data to us willing to become Investor and/or Approved User of the Platform as this definition is described in Terms of Use (Contractual Performance).

Information we collect. In case you complete the form on the Website seeking the pre-seed investment opportunity we will ask your full name, email, company name (if any), WhatsApp contact, and investment capacity. In case you complete the form on the Website seeking to join the waitlist and get early access to features, updates, and opportunities we will ask your full name and email only. We do not collect any personal data automatically

Use of personal data. The only way we use your personal data provided to us is by storing your personal data and contacting you for the purpose of cooperating with you as an Investor or Approved User. Of course, we may also delete your personal data provided in case we do not approve you as an Investor or Approved User or you asked/requested us to do so.

Public Content. No public content, which is not belonging to us, is intended for posting on the Site or through the Service.

Communications. When you sign up for a Service or use certain features, you are opting to receive messages from us. You cannot opt out of receiving certain administrative, transactional, or legal messages from us. Please note that in case you opt out you may miss some important notification from us and hence you relieve us from any liability related to such notification delivery or non-delivery. We may also track your actions in response to the messages you receive from us, such as whether you deleted, opened, or forwarded such messages.

Cookies. We, and third parties with whom we partner, may use cookies, web beacons, tags, scripts, local shared objects such as HTML5 and Flash (sometimes called "flash cookies"), advertising identifiers (including Google’s Advertising ID), and similar technology (jointly "Cookies") in connection with your use of the Service, third party websites, and mobile applications. Cookies may be persistent or stored only during an individual session. We use Cookies once you enter the Website even in case you use it without your account registration. We use Cookies on the Website for process optimization, preferences, notifications sending or displaying, advertising, and analytics. Sharing of personal data. We do not share your personal data with any persons unless our employees, contractors, partners, and affiliates in the course of the Service providing. - The right to file a complaint with the appropriate data protection authority.

However, no method of transmission over the Internet or via a mobile device, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. We may suspend your use of all or part of the Service without notice if we suspect or detect any breach of security. If you believe that your device or personal data is no longer secure, please, notify us immediately at the contact information set out below.

Data transfer. Your providing us with personal data may involve the transfer of such personal data across the border of your jurisdiction as our servers are located in Ukraine. Hence, there is a possibility that data protection and privacy regulations in Ukraine may not offer the same level of protection as it is in your jurisdiction but nevertheless we do our best to provide you with the highest level of personal data protection we are able to provide
